ترجع أصول القضاء الشرعي إلى تكاملية المنهج الإسلامي المعالج لكافة نواحي الحياة ومنها بيان حقوق الأفراد والجماعات وواجباتهم وألية اقتضاء هذه الحقوق وقضائها فكان القضاء وفق الشريعة الإسلامية من عهد الرسول الكريم صلى الله عليه وسلم واستمر العمل في القضاء الشرعي وفق قواعد وأحكام الشريعة الإسلامية حتى يومنا هذا . فمنذ أن أسس المغفور له جلالة الملك المؤسس عبدالله بن الحسين دولة الأردن في 11/نيسان سنة 1921م
